Terms And Conditions

Booking Agreement Terms and Conditions

Sports Travel, Inc. dba Sports Travel and Tours is a tour operator specializing in providing our customers with the opportunity to attend sporting events of a lifetime. These terms and conditions (the "Agreement") describe what you are legally entitled to expect from us when you book your trip through us, in addition to important obligation you make as a customer that effect your legal rights. The terms "we", "us", "our", "Tour Operator" and "Sports Travel" refer to Sports Travel, Inc. dba Sports Travel and Tours. The term "you" "participant" "customer" refers to the customer visiting our website, and/or booking a reservation through us.

Your Acceptance Of These Terms And Conditions

By booking your arrangement with us, you are agreeing to be bound by the terms of this Agreement and any additional terms and conditions of any Supplier that are applicable to your booking, travel arrangements. The lead participant assumes the responsibility of sharing these Terms and Conditions with each trip participant, including payment of all amounts when due.  It is the responsibility of each participant to read our Terms and Conditions in its entirety. Sports Travel is not responsible for any participant’s unawareness of the Terms and Conditions due to the failure of the lead participant to share this information with all other participants/customers.  If you do not agree to these terms you should not make a booking with us.

You acknowledge and agree that we may change these terms and conditions from time to time and that those changes become effective immediately.  You agree to be bound by the terms and conditions that are in effect at the time of your travel or cancellation, whichever applies.  You agree that is your responsibility to be familiar with these terms and conditions and to check back from time to time for any changes.

You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct. You are responsible for informing such other persons of all terms and conditions applicable to their travel arrangements. You understand that you are financially responsible for any use of our services or website by you and those for whom you make bookings.  

You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to the applicable travel related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation.

Booking, Pricing, And Payment

You must make all payments in accordance with the terms we give you.  

    a. Baseball Road Trips Deposit And Balance:
If paying by credit card, full payment is required at the time of booking. If paying by check, the deposit is required within 7 days of your reservation. Final payment is due 90 days prior to departure. If your final payment has not been received, your reservation may be cancelled and your deposit forfeited. You will not be automatically billed for the second and final payment due.

    b.  Baseball Road Trip Late Booking Fee: 
Any reservation for a trip made within 32 days of departure must be paid in full at the time of booking.  In addition, a $50 per person non-refundable late booking fee will be assessed.

    c.    Baseball Hall Of Fame (Induction) Weekend, Major Sporting Events Deposit And Balance:
Full payment is due at the time of booking.

    d.   Customized Flexible Independent Travel And Group Programs Deposit And Balance:
Non-refundable payment in full is required at the time of booking.

If we do not receive any payment due in full and on time, Sports Travel may treat the booking as being canceled by you in which case the cancellation charges set out below will become payable. We reserve the right to refuse a booking without giving any reason and shall, in that event only, return any deposit received. Reservations are non-transferrable.

All payments can be made by check, money order, or credit card (Visa, MasterCard or Discover). If you choose to pay with a credit card, you must provide to us a signed charge authorization agreement for every transaction for your trip.  Your authorization is a binding agreement for us to charge your card and as such you waive any right to chargeback in the case of cancellation for any cause whatever, including a Force Majeure event, as defined herein, and agree to refund policies and procedures as outlined in these Terms and Conditions.  Tour Operator retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback.
The customer acknowledges that the price quoted for any tour or travel arrangements is based upon prices provided for accommodations, transportation, tickets and other components. Should any prices for such components be increased, Sports Travel, Inc. reserves the right and the customer acknowledges the right of Sports Travel, Inc. to increase the tour and travel arrangement price in the amount of any such increase in price.

Any customer given notice of increased cost shall have the right to terminate the reservation on the confirmed program and obtain a full refund of all amounts paid to Sports Travel, Inc. unless such payment was expressly made on a non-refundable basis. Sports Travel, Inc. cannot take responsibility if a client has booked a non-refundable airfare. The acceptance of any tickets, vouchers, or other documentation of tour or travel arrangements shall be deemed to be acceptance of the above General Information, Terms and Conditions by the customer.

Baseball road trips fuel surcharge: We have done our very best at the time of pricing to include all expected fuel costs. If fuel prices rise dramatically, there is the possibility of an added fuel surcharge from our motorcoach vendors to reflect the difference between a standard benchmark for fuel costs and the actual fuel costs for the trip, which may be passed along to our travelers.

Air Travel is not included in the price of any Tour, unless we advise you otherwise.  In either case cancellation charges for Air Travel will be governed by the terms and conditions of the airline.  Customers must NOT purchase air travel tickets to or from the destination until notified by us.  If Customers purchase air travel before confirmation is received and the trip is then cancelled either by the guest or by Sports Travel, Sports Travel will not be responsible for the expense of the ticket.

Changes By You

We are happy to assist in making changes to your trip whenever possible. Whether it is a Baseball Road Trip, Major Sporting Event or Independent Travel Program, all changes are based on availability. At the time the change is made, a $25 administrative fee will be required to make revisions.

Trip Documents

All of your necessary trip information and final documents will be mailed to you 10-14 days before your departure date.   Guests are required to immediately review all aspects of their booking to verify (but not limited to): passenger names, mailing address, email address, telephone number, date of birth, pricing, accommodations, and organized activities on your booking receipt. Please notify us immediately if any omissions and/or corrections are needed regarding the booking details. Passenger(s) voluntarily assumes full and sole responsibility for any and all risks and/or costs involved with failure to report such errors and/or omissions. Passenger is required to verify the accuracy of the passenger’s LEGAL first & last names. It is mandatory that guest names be identical to the Passenger(s) LEGAL first and last names and identical to the names as they appear on booking and travel documents. Our staff is available by phone for any questions.  

What's Included In My Travel?

Baseball Road Trips


●    Hotel Accommodations: Our programs offer a variety of deluxe, moderate and standard accommodations. The deluxe hotels are four- and five-star names such as Westin, Marriott, Hyatt and Sheraton. The moderate option features hotels such as Holiday Inn, Best Western and Clarion, while standard hotels are similar to Days Inn or Comfort Inn properties.  Guests should be aware that hotel room sizes, standards and facilities can vary regionally.  This can include difference in room sizes, bathroom amenities, and dining/meal options.  Sports Travel does not control or own any of the accommodations and is not responsible for differing standards.

Occupancy is outlined in your individual itineraries.  Rooms will be assigned by the respective supplier/s on a run-of-the-house basis.

●    Tickets:  Sports Travel and Tours obtains the best available tickets to each game on our Baseball Road Trips. Typically, seats are located up a level and between the bases versus outfield seats pending availability. Lower level seats within the bases are most often season ticket holder seats. The ballpark, day of the week, and number of season ticket holders determine available seat locations. Your tour host will distribute all tickets prior to each game. If you choose to take advantage of the UTO option below, please remember that it is not refundable or exchangeable.

●    Transportation: Your trip includes deluxe motorcoach transportation to and from all events and hotels. Every motorcoach is air conditioned, has comfortable reclining seats, a restroom and a no smoking policy. On Baseball Road Trips, we make frequent stops for everyone's comfort. To avoid long rides, we fly between cities on regularly scheduled airlines, which is included in the trip cost.

●    Tour Hosts: Hosted trips are led by our experienced tour hosts, who are valuable members of the team. They will be with you for the entire trip to ensure your comfort and enjoyment.

●    Transfer:  Will be according to your individual itinerary. Your final documents will include the available transfer options/costs to your hotel on the first day. If you would prefer a car rental please ask us for details.

Most Baseball Road Trips begin in the hotel lobby approximately 3-4 hours prior to game time on the first day. A designated meeting point and time will be described in your final document packet.

Departure: If you are traveling on a Baseball Road Trip, and the last day of your trip has an afternoon game, Sports Travel and Tours will bring everyone to the airport for your flight home. If passengers are staying over for additional nights, you will be transferred to the Road Trip hotel. All departing flights should be scheduled after 8:00 PM. If the last game is a night game, the trip ends when we arrive at the hotel after the game. We will provide available transfer options/costs to the airport on the last day.

Extra Innings: We will stay until the completion of all games with one exception. If the last game on your trip is a day game, we will depart the ballpark at a designated time to insure for a timely arrival at the airport for return flights home. If you are staying over additional days, you will have the option of being dropped off at our choice hotel or staying at the game. Your tour host will leave your bags with the front desk at the hotel and you will be responsible for your transfer to the hotel upon completion of the game.

Non-Operation Of Baseball Road Trip

All baseball road trip tours are based on a minimum number of 20 participants.  Sports Travel makes every effort to ensure that tours meet their minimum requirements.  However, if the tour drops below the minimum number of participants cancellation or modification of the tour may occur at the sole discretion of Sports Travel.  We may offer alternative tour dates or other travel arrangements.  You may choose to accept these arrangements or to cancel your booking, in which case a full refund will be provided.  Any air cancellation will be in accordance with the terms of the carrier and Sports Travel will not be liable for the carrier’s refusal to make any refund whatsoever.  In such case Sports Travel will not be liable for any additional costs incurred outside of the tour prices such as visa and passport fees, travel insurance or any other purchases made by the guest in anticipation of the tour.

All Other Tours

What's Not Included In My Travel

Any items and matters not referred to in your itinerary are not included in the tour price. This includes, but is not limited to items such as airfare, checked and/or excess baggage; passport and visa fees; trip protection and/or insurances of all kinds; laundry; phone calls; minibar; beverages and meals not detailed in the itinerary; optional experiences; and all items of a personal nature. Additional taxes and surcharges may be collected by foreign governmental and non-governmental entities. The price does not cover costs and expenses, including your return home, if you leave the tour whether of your own volition, our decision based on behavior that disrupts the trip, due to illness, action by any government or other reason. This list is illustrative and not a complete list of every item not included.

Additional Information Important for all Tours

Changes To Itineraries

The customer acknowledges that tour itineraries, accommodations, travel arrangements and other aspects of a tour must at times be modified or cancelled due to acts of God, (including but not limited to, fires, earthquakes, floods, acts of threats of terrorism) unavailability of accommodations or other causes beyond the reasonable control of Sports Travel. Sports Travel reserves the right to make changes to its published itineraries which we deem insignificant and are due to reasons beyond our control. In such cases, we will arrange for the substitution of comparable services. As an example, significant changes do not include the following, change of accommodation to another of the same standard, any change in the itinerary due to holiday, facility closure or weather, and any minor itinerary change where we make a reasonable substitute.  Sports Travel will not be responsible for delays prior to the departure your tour, during the tour or at any time and will not be responsible for any additional cost or loss which may be caused as a result of these delays.

Hotel Accomodations

Most hotels expect departing guests to vacate rooms by 12:00 p.m. and arriving guests to check-in after 3:00 p.m. to allow for maid service. If you have an early arrival or late departure, the front desk staff will assist in storing your bags until check-in time or your departure.

Special Requests: Requests for rollaway beds, connecting/adjoining rooms, and smoking/non-smoking preferences, as well as any requests noted are considered Special Requests. These Special Requests are not guaranteed and will be honored pending availability at check in. Sports Travel and Tours cannot be responsible for Special Requests not being available; however, we will indeed exercise our best efforts to accommodate your requests with our suppliers. Due to fire laws in New York City as well as other metropolitan cities, hotels will not provide rollaway beds.
Single Share:  If you are traveling alone and wish to share a room please make your request when you book your trip. We will reserve you as Single Share and if there is another Single Sharing traveler in your group, we will refund the difference in rates at the end of your trip. We cannot guarantee Single Sharing on a trip until departure.
Extending Your Stay: If you wish to arrive earlier or stay later than our itinerary, we will help you obtain our lowest group rate. These room reservations must be booked through Sports Travel and Tours, are based upon availability, and will be added to your trip cost. Rates listed include hotel taxes.

Non-Smoking Rooms: Hotels now have a Zero Tolerance policy for someone smoking in a non-smoking room. This policy carries with it a financial penalty for any violation. Please be aware that you will be personally responsible for any such penalties, should they occur.

Pre-Existing Medical Conditions/Persons With Disabilities

It is essential that you advise us before booking if you do have any disability or pre-existing medical condition which may affect your trip, or if you have any special requirements as a result of any disability or medical condition (including any which affect the booking process) so that we can assist you in considering the suitability of the arrangements and/or in making the booking. Full details must be confirmed in writing at the time of booking and whenever any change in the condition or disability occurs. Sports Travel will make all reasonable efforts to accommodate requests, but cannot be responsible if ADA accommodations are not available.  Any accommodations provided will be at the sole expense of the guest requiring the accommodation.

The tour guides and tour leaders are, unfortunately, unable to offer additional assistance to passengers with limited mobility and all such assistance will need to be provided by whoever the passenger is traveling with. Participants with disabilities must notify Sports Travel in writing no later than the time of booking of status and of the identity of their non-discounted, paid travel companion who will be responsible for providing all necessary assistance. We may request that you provide a letter from your doctor confirming your fitness to travel.

Tickets And Upgrades

Sports Travel and Tours is not responsible for lost, stolen or damaged tickets. Some major sporting event tickets will be issued on site, the day of the event. Tickets are issued in pairs; odd numbers cannot be guaranteed. Sections, rows and seat numbers cannot be confirmed until day of event.

Upgraded Ticket Option (UTO): The UTO option is available for every event. The UTO will provide you with an opportunity to upgrade the location of your seats. Call for details. Third party travel insurance is strongly suggested if you purchase the UTO, as upgraded tickets are non-refundable (ask us for information). Please note: Rainouts are not covered by most insurance policies.

Rain-Outs

If an event is rained out, cancelled or postponed beyond our control, ticket(s) will be applicable for the rescheduled dates. Sports Travel is not responsible for modifying travel arrangements. Sports Travel will provide refunds only to the extent that refunds are available. This policy does not apply to the VIP Upgrade Package or the UTO. Premium Tickets are non-refundable.

Car Rentals

Items such as tax and airport fees are included in your rental. However, insurance, gasoline, upgrades from your reserved car type, additional drivers, or additional equipment are not included. Your credit card will be charged for any of those additional inclusions by the rental company upon the return of the vehicle.

Cancellations By You

Tour Operator incurs costs with the suppliers of your tour well in advance of your tour date. All suppliers have their own cancellation policies, which apply to your booking.  Upon receipt of your cancellation request we will contact the suppliers for any applicable refunds subject to the supplier’s terms and conditions.  If you are entitled to a refund, please note that the supplier is responsible for this refund, not Tour Operator. Suppliers may choose to provide a travel voucher or credit in lieu of refund.  We are not responsible for a supplier’s failure to pay a refund or for supplier bankruptcy or insolvency.

Baseball Road Trips Cancellation

Refunds are given less $200 administrative fee per traveler if written notice is received in our Hatfield office 90 days or more prior to departure. For cancellation within 90 days of departure there will be no refund. No refunds will be given for unused portions of a program.  

Cancellation Of Baseball Hall Of Fame (Induction) Weekend, Major Sporting Events, Customized Flexible Independent Travel And Weekend Programs:

All payments are non-refundable at the time of booking. No refunds will be given for unused portions of a program. In the event of a cancellation or postponement, Sports Travel, Inc. shall not be responsible for accommodations and transportation prior to and beyond the original scheduled date of the event.

Additionally, for all our trips, clients are subject to any cancellation fees assessed by the purveyors of services including hotels or other suppliers used in the itinerary.  We highly recommend that all clients purchase a trip protection plan.  Sports Travel is not responsible for any expenses incurred by trip members in preparing for a canceled trip (e.g., nonrefundable advance purchase air tickets, visa fees, inoculations, equipment, etc.) or for any additional arrangements.

We have no responsibility for cancellation for airfare.  Such cancellation is your responsibility and you are subject to the terms and conditions of the air carrier.

Cancellation By Sports Travel

If for any reason Sports Travel cancels your trip, excepting in case of a force majeure, an alternative trip of a similar standard will be offered to you.  If this is not acceptable to you, then all moneys paid by you to Sports Travel will be refunded.  Beyond the trip costs paid to us, Sports Travel is not responsible for any loss or damage that arises out of any cancellation for any reason whatsoever.

Force Majeure

Sports Travel, Inc. cannot accept liability, provide any refund, or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected, or you otherwise suffer any loss, injury, death, inconvenience or damage as a result of circumstances amounting to "force majeure". "Force majeure" means any event or circumstances which we or the supplier of the services in question could not foresee or avoid. Such events and circumstances may include, acts of God, actual or threatened, war, insurrection, riots, strikes, civil action, decisions by governments or governing authority, technical or maintenance problems with transport, changes of schedules or operational decisions of air carriers, terrorist activity or the threat thereof, industrial action, natural or nuclear activity, epidemic, pandemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation, adverse weather conditions, fire and all similar events outside our control. In the event of a Force Majeure cancelation, Sports Travel, Inc. will attempt to work with suppliers to obtain refunds or future travel credits.  Any refund provided will be provided by the supplier, not Sports Travel, Inc.

Travel Protection Plan

Unfortunately, even with the best planning, things can go wrong.  Whether the cause is medical, loss of property of baggage or other circumstances, travel protection can help protect your travel investment and is STRONGLY recommended. Such travel protection should be comprehensive and cover at a minimum cancellation, cancel for any reason, curtailment, medical, emergency travel and personal accidents, and damage or loss to personal belongings. Travel protection plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the trip). It also helps with reimbursement for medical emergency costs (including very costly medical evacuation costs), missed connections and baggage loss.

Sports Travel is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel protection plans. Sports Travel cannot evaluate the adequacy of the prospective insured's existing travel protection coverage. If you have any questions about your travel protection, call your insurer or insurance agent or broker.
Declining travel protection plan coverage could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate coverage, we will not be liable for any of your losses howsoever arising, for which trip protection plan coverage would otherwise have been available.   

International Travel And Documentation

Prior to booking international travel, we recommend that you review any U.S. Government’s prohibitions, warnings and advisories applicable to your destinations. By offering travel to any particular destination, we do not represent that travel in such destination is safe or without risk.  If the traveler still chooses to travel to the locale of a warning, the traveler assumes all risk of personal injury, death or property damage that may arise out of or which relates to the type of events warned against.

It is the client’s responsibility to ensure that they have the necessary and current valid passport, visa and vaccinations and inoculations which may be required. Sports Travel shall not be liable for any loss or damage sustained as a result of the client not researching needed visas for entry into the destination country. Passports must be up to date with an expiry at least 6 months after the trip return date.  Many countries also require that your passport have at least two completely blank pages.  For up to date visa requirements US citizens should visit www.travel.state.gov.

When travelling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight. Examples: DHS designated enhanced driver’s license, USA Passport, a foreign government passport. The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on airline ticket(s) and booking records.   For more information you can visit the TSA website at https://www.tsa.gov/travel/security-screening/identification.  

It is essential that you see your physician before booking your trip and before traveling to make sure that you have taken all necessary health precautions. Some vaccinations require more than one visit with a period of weeks between injections. You should visit your physician at least 6 weeks before departure. It is your sole responsibility to secure and/or pay for any and all visas, reciprocity fees, affidavits, immunizations, etc. that are required to be permitted entry into each destination. In some countries you may be subject to entry (reciprocity) fees and/or departure taxes/ exit fees which will be collected at the airports upon entry/departure by local government authorities.  Please note that entry to any country may be refused even if the required information and travel documents are complete.

Any failure of a participant to have proper visas and/or passport will likely result in the participant not being able to leave the country or enter a destination and no refund will be available in any such case and the Tour Operator will have no liability in such case.

Your Conduct/Responsibility

Each participant is expected to act responsibly and adhere to all behavior guidelines established by Sports Travel and our local guides and suppliers. We and our local guides and suppliers reserve the right to remove you from any trip if you endanger yourself or others or disrupt the general well-being of the trip itself. In any such case, there will be no refund.

When you book with us, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid direct at the time to the accommodation owner or manager or other supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us. Sports Travel is not responsible for any costs incurred concerning a guest removed from a vacation/holiday. Guests agree not to hold Sports Travel or any of its related entities liable for any actions taken under these terms and conditions.
Baggage and personal effects are at all times the sole responsibility of the participant.

Non-Responsibility

COVID-19 Release of Liability: By booking a tour at this time, you acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk for yourself and any minors traveling with you, that you or they may be exposed to or infected by COVID-19 by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death even if such injuries or losses occur in a manner that is not foreseeable at the time you book your tour. You acknowledge that exposure to such viruses or disease is an inherent risk of traveling, that cannot be controlled or eliminated by Tour Operator.

You acknowledge that due to the uncertainty of travel at this time, your tour may be postponed or cancelled or changes may be made to itineraries due to closures of certain sites or activities, for which our worry-free policy detailed below shall be in effect. You may also be required to quarantine upon arrival in some locations. Some locations may require you to have a vaccination or proof of a negative test.  You may have additional reentry requirements on your return home.  You are responsible for understanding these requirements and must not rely on Tour Operator to provide these details. You understand that you may become sick before, during, or after the tour and may not be able to travel and such cancellation or interruption will be subject to our cancellation terms below, for which we will not be liable.

You agree that due to uncertainty caused by COVID 19, Tour Operator has strongly encouraged the purchase of travel protection coverage including cancel for any reason coverage if and when available, and that should you fail to purchase travel protection coverage, Tour Operator shall not be liable to any losses howsoever arising.  

You, for yourself, and any minors traveling with you, and on behalf of your and their heirs, assigns, personal representatives and next of kin (The Releasors), HEREBY RELEASE, AND HOLD HARMLESS Sports Travel, its members, officers, agents, and/or employees, suppliers, and other tour members (RELEASEES), of from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part  to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID- 19, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

Sports Travel, Inc. dba Sport Travel and Tours and its employees, shareholders, representatives, and agents (hereinafter "Sports Travel") is a tour operator and uses third-party suppliers to arrange hotel accommodations, tickets, sporting events, tours and transportation, whether by air, motorcoach, or other means. Sports Travel is an independent contractor and is not an employee, agent or representative of any of these suppliers.  Sports Travel does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel, arena, or restaurants, or any other entity that supplies services related to your tour. Sports Travel is not affiliated with any other tour operator. All suppliers are independent contractors, and are not agents or employees or representatives of Sports Travel.  All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all customers agree that neither Sports Travel, nor its employees, agents, or representatives are or may be liable for any loss, injury, or damage to any participant or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of Sports Travel. Therefore, Sports Travel, hold themselves free of responsibility for any damage(s) from any cause(s) whatsoever.  Sports Travel will not be responsible for any damage, expense or inconvenience caused by late air, or motorcoach arrivals or departures or by any change of schedules or other conditions; nor will they be responsible for the loss of, or damage to baggage or any article belonging to the passenger.  The right is also reserved to decline to accept or retain any person traveling under our auspices.  The carriers concerned are not to be held responsible for any act, omission or event during the time passengers are not on board their plane or conveyance.  The passenger contract used by the carriers concerned, when issued, shall constitute the sole contract between the carriers and the purchasers of this tour and/or the passengers.

Additional Risks

Additional risks and dangers may arise including, but not limited to, the hazards of travel which could result in you serious injury or death;  hazards of travel by train, automobile, aircraft and other means of conveyance, animal interactions; hazards at sports events including the risk of being stuck by projectiles including balls and hockey pucks; the behavior of yourself and other attendees; consumption of alcohol; forces of nature, political unrest, other unrest, risks associated with water, food, plants, insects, and acts of national and local governments and unrest and acts of others against governments. These risks are not an exhaustive list but are examples of many kinds of risks. You are voluntarily participating in these activities with the knowledge that there are significant dangers involved, and you hereby agree to accept any and all risks. As lawful consideration for the agreement with Sports Travel to participate in such trips and activities you agree you will not make a claim against Sports Travel, its related companies or its personnel or sue for bodily injury, emotional trauma, death, property loss or damage or other loss, cost or expense, however caused, as a result of or related to your contracting for, traveling to or from, or in any and every other way participating in the trip. You release Sports Travel, its related companies and its personnel from any and all claims, known or unknown, arising from contracting for, traveling to or from, and in any and every way participating in a trip. This release of liability and assumption of risk agreement is entered into on behalf of you and all members of your family and party, also including minors. This agreement also binds your heirs, legal representatives and assigns.

Third Party Advertisers

Sports Travel, Inc. may allow third party advertisers to advertise on the Site. Sports Travel, Inc. undertakes no responsibility for User's dealings with, including any on-line or other purchases from, any third-party advertisers. Sports Travel, Inc. shall not be responsible for any loss or damage incurred by User in its dealings with third party advertisers.

Photographic Likeness

The customer acknowledges Sports Travel, Inc.'s right to use any photographs for promotional material unless Sports Travel, Inc. receives written notification of the customer's declination.

Severability

If any provision of these terms and conditions shall be held unenforceable, such provision shall be struck and the remainder shall remain enforceable.

Jurisdiction And Applicable Law

These Booking Conditions and any agreement to which they apply are governed in all respects by the laws of the state of Massachusetts without regard to conflicts of law principles and subject to the jurisdiction of courts in Massachusetts.  All guest claims must be submitted in writing and received by Sports Travel no later than sixty (60) days after the completion of the Sports Travel vacation.  Guest claims not submitted and received within this time shall be deemed waived and barred.
