2012 Baseball Create-Your-Own Baseball Road Trip Contest Rules

SportsTravelandTours.com, will conduct the contest as described in these rules, and by participating, each participant agree as follows:

A. How to Enter

1. Cast your vote by completing this Online Survey.

B. Voter Participant Prize Structure

1. The winner will be chosen at random from all eligible entrants who voted for the winning Baseball Road Trip itinerary and will receive a $50 Baseball Road Trip Credit good toward the winning trip.
2. Winners will be contacted from the information provided by the entrant. If Sports Travel and Tours is unable to contact the winner, it reserves the right to select another winner at its sole discretion.
3. The prize(s) that may be awarded to the eligible winner(s) are not transferable, redeemable for cash or exchangeable for any other prize.
4. Grand Prize Winner must present a state authorized identification prior to being awarded the prize.
5. If a winner cannot be contacted or is disqualified for any reason, Sports Travel and Tours reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion.

C. Eligibility and Limitations

1. Participants and winner(s) must be at least 18 years old, as determined by Sports Travel and Tours.
2. Contest participants and winner(s) can be U.S. residents, or residents of any country that is NOT embargoed by the United States.
3. The participant can enter as many entries as he/she likes on this Photo contest.
4. Employees of Sports Travel and Tours or their immediate family are not eligible to participate and win. The term "immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.

D. Phone and Delivery Disclaimer

1. Sports Travel and Tours disclaims all liability for the inability of a participant to complete a cross-posting to a social networking site, text message entry due to equipment malfunction, inadvertent disconnections, acts beyond Sports Travel and Tours’ control, or otherwise.
2. For all contests Sports Travel and Tours disclaims all liability for any delays, mis-delivery, loss, or failure in the delivery of any item sent by text, electronic transmission, or other delivery method.
3. Sports Travel and Tours is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed incomplete or delayed transmission of online entries, traffic congestion on the Internet or at any social networking website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Contest.

E. Publicity; Use of Personal Information

1. By participating, where allowed by law, all participants and winner(s) grant Sports Travel and Tours exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use.
2. By participating in the Contest, where allowed by law, participants agree that Sports Travel and Tours may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
3. By participating in the Contest, where allowed by law, participants agree that Sports Travel and Tours has the right use the images entered into the contest for marketing and other purposes; and that the photos are the sole property of the participant.

F. Release

1. By participating in the Contest, each participant and winner waives any and all claims of liability against Sports Travel and Tours, its employees and agents, and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize.
2. In order to receive a prize, participants may have to sign an official waiver form provided by Sports Travel and Tours.

G. Conduct and Decisions

1. By participating in the Contest, participants agree to be bound by the decisions of Sports Travel and Tours.
2. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified.
3. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited.
4. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of Sports Travel and Tours, Sports Travel and Tours reserves the right to terminate this Contest, or make such other decisions regarding the outcome as Sports Travel and Tours deems appropriate.
5. Sports Travel and Tours will interpret and resolve any disputes, ambiguities and conflicting claims in accordance with the rules stated in this contest. All decisions will be made by Sports Travel and Tours and such decisions are final. Sports Travel and Tours may waive any of these rules in its sole discretion.
6. Any attempt by an entrant or any other individual to deliberately circumvent, disrupt, damage or undermine the legitimate operation of this Contest is a violation of criminal and civil laws. Should such an attempt be made, Sports Travel and Tours reserves the right to seek civil and/or criminal prosecution and/or damages from any such person to the fullest extent permitted by law.

H. Taxes

1. Any valuation of the prize(s) stated above is based on available information provided to Sports Travel and Tours, and the value of any prize awarded to a winner may be reported for tax purposes as required by law.
2. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prizes which are not specifically provided for in the official rules.
3. Each winner must provide Sports Travel and Tours with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded.
4. Any person winning over $600 in prizes from Sports Travel and Tours will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

I. Compliance with the Law

1. The conduct of the Contest is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein.
2. Sports Travel and Tours shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, providing specific written information about the Contest, etc. as required by local and state law.

J. Miscellaneous

1. The contest is void where it is prohibited by local or state laws.
2. Odds of winning depend upon the number of participants.
3. Grand Prize winner must submit proof of eligibility and sign a release form to claim the prize.
4. Sports Travel and Tours may substitute prizes, amend the rules or discontinue the Contest at any time.
5. Sports Travel and Tours disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest.
6. Sports Travel and Tours may conduct the Contest concurrently and simultaneously via the Internet and on social networking sites.
7. For a copy of the rules, or where required by law, the list of winners, interested persons may visit the business office of Sports Travel and Tours during business hours or visit the Sports Travel and Tours website.
8. All mailed entries become the property of Sports Travel and Tours and will not be returned.
